From the speaker

  • The first mention
  • foundation models
  • sometimes referred to as General Purpose AI
  • the middle of May 2022
  • From the French government

Our interpretation

  • The claim concerns the earliest explicit mention of foundation models or general-purpose AI in the formal AI Act legislative process.
  • Because Marcus expressly includes general-purpose AI, an earlier negotiating text using that term is a counterexample even if it proposes exemptions rather than new duties.
  • The target period covers the process from the April 2021 proposal through the claimed first-mention month, May 2022. Establishing a first occurrence requires checking the preceding period.

Counts as supported if: A French Presidency text from mid-May 2022 is the earliest explicit reference, with the preceding legislative record containing no such mention.

Counts as contradicted if: An authenticated negotiating document dated before mid-May 2022 explicitly mentions general-purpose AI or foundation models.

Retrospective: these criteria were written after the outcome was public.

Current assessment

Scored on a plain reading. The speaker named no measure for this claim, so it was judged on the reading an informed reader would take, stated below under our interpretation. Both reviews had to find that reading fair.

Rationale

The Council's November 29, 2021 negotiating text explicitly mentions general-purpose AI and includes a dedicated Article 52a. May 2022 therefore was not its first mention in the AI Act process. This conclusion concerns the words first mention; it does not equate that earlier treatment with every obligation proposed later.

Limitations

  • An earlier counterexample disproves the claimed date without establishing the absolute earliest mention.
  • The result follows Marcus's explicit inclusion of general-purpose AI, rather than requiring the exact phrase foundation models.

Evidence (1 item)

  • Goes against the claim: Council of the European Union, Slovenian Presidency,

The provisions of this Article shall apply irrespective of whether the general purpose AI system is open source software or not.

Why it matters here: The November 2021 compromise text explicitly mentions general-purpose AI and contains a dedicated Article 52a. This predates the claimed first mention in May 2022.
